Terms of Use

1. Parties & Agreement

These Terms of Use ("Terms") form a legally binding agreement between you ("Client", "User", "you") and Invenzee Buildcap Fintech Pvt Ltd operating as Digital Anthem ("Company", "we", "us").

Registered Office: Orbit Mall, Vijay Nagar, Indore, Madhya Pradesh – 452010, India.

By subscribing to any service, filling a form, or using our website, you confirm you are at least 18 years old and have the authority to enter into this agreement on behalf of your business.

2. Services Provided

Digital Anthem provides AI-powered business software and services including:

• AI CRM — Lead capture, scoring, and automated follow-up
• AI HRM — Resume screening, attendance, payroll automation
• Websites & Portals — AI-built websites and customer portals
• Social Media AI — Automated content creation and posting
• WhatsApp Automation — Official Meta API-based messaging
• Digital Marketing — AI-managed ad campaigns and SEO
• Mobile Apps — Custom Android and iOS application development
• Master AI Agent — Unified AI workflow automation via n8n

We reserve the right to modify, suspend, or discontinue any service with reasonable notice.

3. Subscriptions & Payment

3.1 Subscription Plans

• Starter: ₹2,999/month — AI CRM and basic features
• Growth: ₹6,999/month — Full AI suite including HRM and Social Media AI
• Enterprise: Custom pricing — Full suite with dedicated support

3.2 Payment Terms

• Subscriptions are billed monthly in advance.
• All prices are in Indian Rupees (INR) and inclusive of applicable GST.
• Payment is due within 7 days of invoice date.
• Late payment (beyond 15 days) may result in service suspension.
• Accepted payment methods: Bank transfer (NEFT/IMPS/UPI), cheque.

3.3 Price Changes

We will provide 30 days' advance notice of any subscription price increases via email.

4. Intellectual Property

4.1 Our IP

All software, AI models, automation workflows, website designs, content, logos, and trademarks of Digital Anthem are the exclusive property of Invenzee Buildcap Fintech Pvt Ltd. You may not copy, reverse-engineer, resell, or use our technology without written permission.

4.2 Your IP

You retain ownership of all content, data, and materials you provide to us. By using our services, you grant us a limited licence to process your data solely to provide the agreed services.

4.3 AI-Generated Content

Content generated by our AI on your behalf (social media posts, email sequences, website copy, etc.) is owned by you upon creation, subject to continued subscription.

5. Acceptable Use

You agree NOT to use our services to:

• Send spam, unsolicited bulk messages, or engage in phishing.
• Violate any applicable Indian law or regulation.
• Infringe any third party's intellectual property rights.
• Distribute malware, viruses, or harmful software.
• Conduct illegal activities or promote fraudulent schemes.
• Harass, abuse, or threaten individuals.
• Violate WhatsApp Business Policy or Meta's terms of service.
• Attempt to gain unauthorised access to our systems.

Violation of these rules will result in immediate account termination without refund.

6. Service Level & Uptime

• We target 99% uptime for hosted services.
• Scheduled maintenance will be communicated 24 hours in advance.
• We are not liable for downtime caused by third-party providers (Meta, Google, cloud hosting) or force majeure events.
• Support is available Monday–Saturday, 10 AM – 7 PM IST via phone and WhatsApp.

8. Confidentiality

Both parties agree to keep confidential all non-public business information shared during the engagement. This obligation survives termination of services for a period of 3 years.

9. Termination

• By You: Cancel subscription with 30 days' written notice to info@digitalanthem.in.
• By Us: We may terminate for cause (policy violation, non-payment) with immediate effect, or for convenience with 30 days' notice.
• Upon termination, you will have 30 days to export your data before it is deleted.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of courts in Indore, Madhya Pradesh, India.

Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for at least 30 days.

11. Changes to Terms

We may update these Terms with 30 days' notice to active subscribers. Continued use of our services after the effective date constitutes acceptance of the updated Terms.
